About the role
NAB Wealth is undertaking a proactive review of financial advice provided to customers over recent years (called the Customer Response Initiative) to ensure our customers received the right outcome.
We are building a team of specialists to conduct the reviews, including legal team members.
The Legal Counsel role will support the remediation program in a number of different capacities, including: complaint/dispute resolution, document drafting, contract management (with external service suppliers), dealing with legal questions/issues arising from advice reviews and more.
The successful candidate will have the following key responsibilities:
Advising the program’s case assessors on legal and regulatory matters relating to the provision of financial advice and other related areas (e.g. privacy)
Managing complaints and disputes from customers in relation to advice reviews (including dealing with FOS)
drafting and reviewing documents and policies involving legal issues arising from the work of the program
liaising with the NAB Wealth Legal and BAU Advice Dispute Resolution teams, to ensure consistency of approach
Assisting with general governance of program (including contract management with external services provider)
Skills and experience required
You will hold a Bachelor of Laws qualification, be admitted to Practice as a Barrister or Solicitor of a Supreme Court and hold a current Legal Practicing Certificate.
Experience of financial advice disputes is essential. Broader experience of financial planning compliance and regulatory investigations would be an advantage.
You should have a strong customer-focus and demonstrated ability to communicate and empathise with customers.
Clear and concise written communication skills are essential, to convey the outcomes of the reviews so that customers can readily understand the often complex analysis and conclusions.
You should possess strong advocacy skills, as you will participate in various forms of dispute resolution (including mediations and conciliation conferences).
You will have at least 3+ years post-admission experience in private and/or corporate legal practice in retail financial services, with a particular emphasis on financial advice disputes.
